Terms of Service

These Terms of Service ("Terms") govern your use of bluplanstudio.com, including the /start project questionnaire and the invite-only client portal (together, the "Site"), operated by BluPlan Studio ("BluPlan," "we," "us," or "our"). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site. You must be at least 18 years old to submit an inquiry or hold a portal account.

The Site provides general information about our residential design and permitting services, lets you request a consultation, and gives active clients access to a private portal for their projects.

Content on the Site, including articles, cost discussions, ballpark figures, and third-party construction benchmarks, is general information only. It is not a quote, a design recommendation for your specific property, legal advice, or a guarantee that any project will be approved by a permitting authority. Construction costs vary by contractor, property, and market conditions. Professional services are provided only under a separate written service agreement between you and BluPlan, and if these Terms conflict with that agreement, the service agreement controls for those services.

Portal accounts are created by invitation only. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly at admin@bluplanstudio.com if you suspect unauthorized use. You agree to use the portal only for your own projects and communications with us, and not to upload content that is unlawful, infringing, or malicious. We may suspend or terminate portal access for violation of these Terms or at the end of an engagement, subject to any obligations in your service agreement.

When you submit information through our forms or the portal, you represent that it is accurate to your knowledge and that you are entitled to provide it. You grant us permission to use submitted information to respond to you, evaluate and provide services, and as described in our Privacy Policy. Do not submit confidential information you are not authorized to disclose.

The Site and its content, including text, graphics, logos, photographs, floor plans, and design imagery, are owned by BluPlan or its licensors and are protected by copyright and other intellectual property laws. You may view and print Site content for personal, non-commercial use. You may not reproduce, distribute, sell, or create derivative works from Site content, including floor plans and design drawings, without our prior written permission. Ownership and license terms for project deliverables are governed by your service agreement.

You agree not to:

• Access the Site by automated means (scraping, crawling, bulk downloading) except standard search engine indexing;
• Interfere with the Site's operation, attempt to bypass security or access controls, or probe for vulnerabilities without authorization;
• Submit false, misleading, or fraudulent inquiries;
• Use the Site for any unlawful purpose.

The Site uses third-party services (described in our Privacy Policy and Cookie Policy) and may link to external websites. We are not responsible for the content or practices of third-party sites and services; your use of them is governed by their own terms.

The Site is provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that information on it is complete or current.

To the fullest extent permitted by law, BluPlan will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Site. Our total liability for claims arising from use of the Site will not exceed one hundred dollars ($100). This section does not limit liability that cannot be limited under applicable law, and it does not apply to professional services provided under a separate service agreement, which has its own terms.

You agree to indemnify and hold BluPlan harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.

We may suspend or terminate access to the Site at any time for conduct that violates these Terms or harms the Site or other users. Sections that by their nature should survive termination (including sections 5, 8, 9, and 10) survive.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction.

We may update these Terms from time to time. Changes take effect when posted on this page with an updated date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy, Cookie Policy, and any service agreement between you and BluPlan, are the entire agreement regarding the Site. Our failure to enforce a provision is not a waiver of it.
